The petitioner seeks bail in Sessions Trial No. 207 of 2015, arising out of Kankarbagh P.S. Case No. 104 of 2014, registered for the offences punishable under Sections 304B and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that prayer for bail of the petitioner was earlier twice rejected by this Court vide order dated 06.08.2015 in Cr. Misc. No. 13036 of 2015 and the order dated 16.11.2016 in Cr. Misc. No. 22782 of 2016. Vide order dated 16.11.2016 passed in Cr. Misc. No. 22782 of 2016, this Court directed the trial court to hold the trial on day-to-day basis and conclude the same within three months from the date of receipt/production of a copy of this order.

Patna High Court Cr.Misc. No.14796 of 2017 (2) dt.26-04-2017 2/2 Learned counsel for the petitioner submits that the trial has not yet been concluded. Learned counsel for the informant informed this Court that the case was pending for the F.S.L. report and the F.S.L. report has already been produced in the court below and, now the prosecution evidence has been closed. The case is pending for argument.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is again rejected.
