2. The petitioner is apprehending his arrest in connection with Barachatti (Mohanpur) P.S. Case No. 614 of 2022 dated 14.07.2022 registered for the offences punishable under Sections 406, 420, 467 and 468 of the Indian Penal Code.
3. As per the prosecution case, the petitioner and the co-accused persons under criminal conspiracy have committed cheating with the informant at the time of the execution of sale deed by taking advantage of his old age and illiteracy.
4. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. The petitioner has no criminal antecedent as stated in para 3 of the
Patna High Court CR. MISC. No.11122 of 2025(2) dt.09-05-2025 2/3 bail petition. Learned counsel further submitted that it is a case of civil nature. It is further submitted that at the time of execution of sale deed the person who is executing the sale deed has to appear before the Registrar and accept how much money he has received and what area of land he is selling. Therefore, the allegation levelled against the petitioner in the F.I.R, appears to be false and baseless. The co-accused have already been granted anticipatory bail by this Court vide order dated 12.02.2024 passed in Cr. Misc. No. 60782 of 2023 and vide order dated 08.11.2023 passed in Cr. Misc. No. 65382 of 2023. The petitioner is only alleged to be the deed writer and no way benefits in this case as any manner rather he has only performed his official duty.
5. Learned A.P.P. for the State has vehemently opposed the prayer of anticipatory bail of the petitioner.
6. Considering the aforesaid facts and circumstances and the materials available on the record, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Gaya in connection with Barachatti
Patna High Court CR. MISC. No.11122 of 2025(2) dt.09-05-2025 3/3 (Mohanpur) P.S. Case No. 614 of 2022, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
7. The application stands allowed.
