2. The petitioner has prayed for bail in connection with Supaul Cyber P.S. Case No. 40 of 2025 registered for the offence punishable under Sections 303(2), 318(4) of the B.N.S., 2023 and Sections 66(c), 66(D) of the I.T. Act.
3. The case of the prosecution, in short, is that the mobile of the informant was stolen by an unknown person. The informant made every endeavor to get his SIM closed. However, the person who had stolen the mobile phone allegedly managed to port the SIM card into JIO and a sum of Rs. 35,000/- was withdrawn from the informant's bank account.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.12450 of 2026(3) dt.11-03-2026 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that the name of this petitioner has surfaced during the course of investigation in the confessional statement of Sandeep Kumar and the main thrust of allegation is against Sandeep Kumar who has already been granted bail by this court vide Cr. Misc. No. 8416 of 2026. No specific role is alleged against this petitioner. Moreover, the petitioner is languishing in judicial custody since 07.10.2025.
5. The application for bail is opposed by learned APP for the State and submits that the petitioner is having criminal antecedent of eight cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail with the condition that the petitioner shall cooperate in the trial and shall remain physically present on each and every date fixed by the learned trial court and shall also mark his attendance at Salkhua P.S. weekly. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul
