JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-02-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 448, 352, 380, 354B, 376/ 511 of the Indian Penal Code. It is alleged that the accused persons entered into the house of the informant and assaulted her and also took away ornaments. It is further alleged that this petitioner attempted to commit rape upon the informant and also tore her blouse. Learned counsel for the petitioner submitted that the police after investigation submitted charge sheet only under Sections 341, 323, 354, 504 and 34 of the Indian Penal Code. It is further submitted that the petitioner filed a case before the Gram Kachahari in which the informant and her family members were held guilty.

No.7287 of 2015 (2) dt.23-02-2015 Considering the above facts, let the above named petitioner be released on anticipatory bail , in the event of arrear or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Biraul at Benipur in Biraul P.S.Case No.373 of 2013, subject to the conditions as laid down u/s 438(2) Cr.P.C.
