JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 07-06-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are in custody since 07.01.2017 in connection with Nawada Nagar (Kadirganj) P.S. Case No. 12 of 2017 for the offence under section 30 (a) of Bihar Prohibition & Excise Act, 2016.

From perusal of the F.I.R. it appears that three persons, namely, Mithun Kumar Singh @ Mithun Singh (petitioner no.1), Deepak Singh and Mithlesh Kumar were apprehended by the Police on 7th January 2017 with 1300 litres of illicit country made liquor and co-accused Rajesh Kumar and Mithlesh Kumar have already been granted bail by different co-

Patna High Court Cr.Misc. No.22319 of 2017 (4) dt.07-06-2017 2/2 ordinate Bench of this Court vide Cr. Misc. Nos. 24591 and 16222 of 2017, order dated 29.05.2017 and 03.05.2017. Having regard to the fact that co-accused have already been granted bail by this Court in Criminal Misc. Nos. 24591 and 16222 of 2017, I am inclined to grant the privilege of bail to the petitioners. Let the petitioners, above named, be enlarged on bail on their furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada or Successor Court in connection with Nawada Nagar (Kadirganj) P.S. Case No. 12 of 2017, subject to the condition that the petitioners will extend full cooperation in conclusion of the trial and they will not, in any manner, influence the witnesses.
