====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 13-05-2025 Heard Mrs. Urmila Kumari, learned counsel for the petitioners and Mrs. Shyama Rani for the informant beside the learned APP.

2. The petitioner apprehends his arrest in connection with Nautan P.S. Case No. 236 of 2024 for the offence registered under sections 341, 323, 325, 307, 379, 504, 506/34 IPC and Section 27 of Arms Act lodged on 06.12.2023 by the informant, Narsing Singh.

3. As per the prosecution story, the informant alleged that due to land dispute, the accused persons became aggressor and the allegation is that:

Patna High Court CR. MISC. No.12306 of 2025(3) dt.13-05-2025 2/3 (i) Vishal Singh opened fire and also assaulted Abhishek with farsa causing head injury;

(ii) he assaulted Basudeo Singh with farsa causing injury in his finger;

(iii) Bullet Singh assaulted Abhishek Singh on the head but hand was injured;

(iv) Rajan assaulted Abhishek again with iron rod causing injury on his right hand whereas Manpreet assaulted Abhishek;

(v) Mahendra and Manpreet assaulted Basudeo Singh;

The allegation of snatching of the amount and ornament is also there, which led to the FIR.

Though learned counsel for the petitioners tried to impress upon this Court about the innocence of the two petitioners submitting that due to land dispute, there was free fight, there is case and counter case but exaggerated FIR is there, learned counsel for the informant has taken this Court to the injury report to show that the injuries on Narsing Singh and Basudeo Singh have been found to be grievous in nature.

5. Considering the submissions of the parties as also the injury that has come on record coupled with the allegation against the two petitioners, certainly, no case of anticipatory bail

Patna High Court CR. MISC. No.12306 of 2025(3) dt.13-05-2025 3/3 is made out.
