====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-02-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 471, 120(b), 506/34 of the Indian Penal Code.

3. It is alleged that this petitioner, in connivance with other accused persons purchased 2 katha 5 dhurs land of Khata No. 67, Khesra No. 259 of the informant on 21.5.24 by deceiving the son of informant and later on, they tried to forcibly take possession over the said land and also threatened informant with dire consequences.

4. Learned counsel for the petitioner submits that petitioner is bona fide purchaser of the land in question and after paying full consideration amount, he has purchased the said land. There is delay of 39 days in lodging the F.I.R. which itself

Patna High Court CR. MISC. No.14090 of 2025(2) dt.27-02-2025 2/2 raises doubt over the veracity of prosecution case. Moreover, dispute involved in this case is regarding sale and purchase of land which is purely civil in nature.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation and other facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Areraj P. S. Case No. 81 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
