JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2017 This is an application for grant of bail for offences punishable under Sections 147, 148, 149, 307, 332, 302, 364 and 120B of the Indian Penal Code and 27 of the Arms Act and 17 of the CLA Act.

It has been submitted on behalf of the petitioner that for the same occurrence three cases have been lodged against the petitioner and in two cases he has been granted bail. In this case it is alleged that in course of fleeing away petitioner was apprehended along with other co-accused persons and he is in custody since 30.09.2016.

Heard learned A.P.P. also. He has opposed the prayer for bail submitting that there are materials against the petitioner in several paragraphs of the case diary.

Patna High Court Cr.Misc. No.10232 of 2017 (3) dt.03-04-2017 2/2 Having heard both sides, in view of the allegation as alleged, I am not inclined to grant bail to the petitioner. However, the court below, i.e., learned Chief Judicial Magistrate, Sitamarhi, is directed to expedite the trial in connection with Bairgania P. S. Case no. 64 of 2005.

Accordingly, this application is dismissed.
