The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 323, 341, 353, 427, 307, 504 and 506 of the Indian Penal Code.
The prosecution case is that the farmers were trying to lift the Urea fertilizer from the trucks forcibly when the informant being S.I. of Murliganj Police Station brought the trucks to the premises of M/s Krishi Vikash Kendra, whose proprietor is Gopal Agrawal when the petitioners and other accused persons entered into the premises and started
Patna High Court Cr.Misc. No.6110 of 2016 (2) dt.08-02-2016 2/2 damaging the trucks as a result the motorcycle parked in the premises got damaged.
It is submitted by learned counsel for the petitioners that the accusation is omnibus and general against the mob and the case has been lodged in order to conceal the irregularity committed by the fertilizer dealer. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the accusation against the mob, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No. 18 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
