The petitioner seeks regular bail in connection with Sitamarhi P.S. Case No. 602 of 2016 (G.R. No. 2927 of 2016) registered for the offences punishable under Sections 385 and 387 of the Indian Penal Code.
The informant in his written report submitted before S.H.O. has alleged that this petitioner made demand Rs. 1,00,000/- as rangdari for which he gave several calls over his mobile.
Learned counsel for the petitioner submits that he was a labourer in the shop of the informant and on account of some differences as regards payment of his wages, some
Patna High Court Cr.Misc. No.5858 of 2017 (2) dt.08-02-2017 2/2 altercation took place and the informant lodged this false case. No incriminating article has been recovered from the possession of the petitioner. The mobile which was seized from the possession of the petitioner, bears signature of the persons, who are resident of different places.
Learned APP for the State opposed the submission. Considering the nature of allegation and the facts and circumstances, the prayer for bail application is allowed. The petitioner, Vijay Kumar @ Laddu Singh, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 602 of 2016 (G.R. No. 2927 of 2016).
