JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-03-2019 The petitioner apprehends his arrest in connection with Nayagaon P.S.Case No. 46 of 2013 registered under Sections 147,148,149 and 307 of the Indian penal Code and 27 of the Arms Act.

Earlier prayer for anticipatory bail of the petitioner was twice rejected vide order dated 23.02.2017 and 21.06.2018 passed in Cr.Misc. No. 7536 of 2017 and Cr. Misc. No. 32213 of 2018 respectively.

Submission of learned counsel for the petitioner is that he has come before this Court only for sympathetic consideration as the mother of the petitioner is on death bed and due to that he could not surrender and now is ready to surrender if such direction is given by this Court.

Patna High Court CR. MISC. No.14921 of 2019(2) dt.27-03-2019 2/2 Having heard both sides and in view of the facts and circumstances as well as conduct of the petitioner, I am not inclined to interfere with the earlier order passed by this Court. However, if petitioner surrenders and makes prayer for regular bail, the same shall be considered on its own merit without being prejudiced by this Court and if possible, disposed of, if possible, on the same day.
