====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 15-11-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Patepur P.S. Case No. 222 of 2020 for the offence under Sections 392 of the Indian Penal Code.

According to the prosecution case, three miscreants robbed the money to the tune of Rs. 3800/ along with other movable articles and documents of the informant. Learned counsel appearing for the petitioner submits the petitioner is innocent and has not committed any offence. In fact, the petitioner has not been named in the F.I.R. and he has falsely been implicated in this case due to dirty village politics. Moreover, the co-accused, namely, Sonu

Patna High Court CR. MISC. No.21839 of 2021(3) dt.15-11-2021 2/2 Kumar, having more or less similar allegation has already been granted regular bail by a co-ordinate Bench of this Court vide order dated 12.08.2021 passed in Cr. Misc. No. 15876 of 2021. The petitioner is rotting in judicial custody since 07.12.2020.

Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Vaishali at Hajipur in connection with Patepur P.S. Case No. 222 of 2020.
