JUSTICE ASHUTOSH KUMAR ORAL ORDER 01-06-2020 The petitioner, who is in custody since 18.09.2019 seeks bail in connection with Chausa P.S. Case No. 122/2018 dated 24.05.2018, instituted for the offences under Section 302/34 of the Indian Penal Code. The informant in her FIR has alleged that his son (deceased) was taken away on a motorcycle by one Mantosh Singh alias Matukki for the purposes of returning Rs. 3,00,000/- which he had taken from the deceased. Later, when the son of the informant did not return, a search was made when the informant was told by the villagers that they had seen the deceased being dragged by Mantosh Singh and many others including the petitioner towards some unknown destination. The dead body of the son of the informant was found in a
Patna High Court CR. MISC. No.9936 of 2020(3) dt.01-06-2020 2/2 maize field. From a look at the dead body, it appeared that the deceased was strangulated to death.
There does not appear to be any specific accusation against the petitioner and according to the impugned order, charge sheet has been submitted against some of the accused persons but investigation is pending as against the petitioner.
Considering the vague nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned F.T.C.-I, Madhepura in connection with Chausa P.S. Case No. 122/18.
The application stands allowed.
