====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-07-2026 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 115(2), 103(1), 316(2), 61, 352, 353, 32, 3(5) of the Bharatiya Nyaya Sanhita.

Case of the informant, in brief, is that her husband used to work as a welder in the vicinity of their village but on 22.05.2024, on the inducement of the F.I.R. named accused persons, including this petitioner, husband of the informant went to work in Barauni in lieu of earning Rs. 20,000/- per month. On 30.05.2024, informant received an information on mobile phone that her husband was killed. Informant suspects that this petitioner along with other accused persons killed her husband by strangulation. In this regard, panchayati was also held twice but the accused did not attend the same and on 29.07.2025, they

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner is simply victim of false implication due to oblique and ulterior motive. There is no eye witness of the occurrence and only suspicion has been raised against petitioner. Post-mortem of the deceased has not been conducted and during investigation, no material has come to substantiate the allegation against petitioner. There is inordinate delay of about 1 year and 3 months in the complaint case as the alleged occurrence took place on 30.05.2024 but complaint case was lodged on 19.08.2025, which itself raises doubt over veracity of the prosecution story. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering backdrop of the case, nature of accusation, delay in lodging the complaint case, materials available on record and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on
