JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-06-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in connection with CIII No. 11 of 2020 for the offenses under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. In the instant case 1.5 liters of liquor is alleged to have been recovered from a hutment of Virendra Manjhi. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner has been falsely roped in this case.
Considering the fact that the petitioner has no criminal antecedent, nothing was recovered from his possession and the quantity of liquor seized in this case, the Court is
Patna High Court CR. MISC. No.9533 of 2020(2) dt.10-06-2020 2/2 inclined to grant anticipatory bail to the petitioner. Let the petitioner, above named, in the event of arrest or surrender before the court below within a period of four weeks, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum- Special Judge (Excise Act), Siwan in connection with CIII No. 11 of 2020, subject to the condition that on release the petitioner shall render his services as volunteer to combat the pandemic of Covid-19 for a period of one month. He is required to report to the Civil Surgeon/ Nodal Officer, Covid-19, Siwan, who shall utilize his services appropriately.
