Petitioners are apprehending their arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 419, 420, 467, 468, 120B of the I.P.C. It is alleged that petitioner No.

impersonated the complainant and executed a sale deed with

Patna High Court Cr.Misc. No.15315 of 2015 (2) dt.13-04-2015 2/3 regard to the land of the complainant claiming himself to be the son of Puranmal Maharaj, the original land holder. It is submitted by learned counsel for the petitioners that initially the complaint was filed which was referred to the police station under Section 156(3) of the Cr.P.C but during investigation the accusation was not found true and ultimately final form was submitted and subsequently protestcum-complaint was filed leading to issuance of process. The petitioner No. 1 claims himself to be the heirs of original land holder and executed the sale deed in favour of petitioner No. 2. Petitioner No. 3 is identifier, petitioner No. 4 is a witness to the sale deed, petitioner No. 5 is alleged to have drafted the sale deed and petitioner Nos.

6 and 7 got the sale deed executed. Moreover the sale deed was executed on 23.03.2010 whereas the initial complaint was filed on 30.03.2010. It is submitted by learned counsel for the petitioners that petitioner No. 1 was the servant of the original land holder Puranmal Maharaj and he fraudulently impersonated the complainant and executed the sale deed. Considering the accusation in the background of claim and counter claim with regard to the land in question, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs.
