The petitioner apprehends her arrest in Sangrampur P.S. Case No. 86 of 2014, registered for the offences punishable under Section 409 and other Sections of the Indian Penal Code. Siaram Pandit, the then incharge headmaster and the petitioner Nirmala Devi being secretary of Bihar Siksha Samiti withdrew Rs. 1,92,000/- for construction of the school building, but it transpired that work of only Rs. 1,12,143/- was done. The petitioner and the headmaster of the school misappropriated Rs. 78,857/-.

Learned counsel for the petitioner submits that the petitioner is ready to deposit Rs. 40,000/- the half of the amount alleged to have been misappropriated.

No.7117 of 2015 (2) dt.20-02-2015 2/2 Considering the facts aforesaid and the fact that if the petitioner deposits Rs. 40,000/- within one month from the date of receipt/production of a copy of this order then the petitioner, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Munger in connection with Sangrampur P.S. Case No. 86 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
