JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 08-06-2015 The petitioner apprehends his arrest in relation to Kanti P.S. Case No. 387 of 2011 registered under Sections 467, 468, 420 of the Indian Penal Code pending before Sub-Divisional Judicial Magistrate (West), Muzaffarpur.

The allegation against the petitioner is that he fraudulently withdraw the amount as mobile phone bill and other charges in the capacity of Chairman of the Cooperative which is substantially not denied. In that view of the matter, I am not inclined to entertain this application. It is, accordingly, dismissed.

However, petitioner is directed to surrender before the court below within four weeks and pray for regular bail where the court below would consider the same without being prejudiced by the order of this Court.
