JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-04-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307 and 504 of the Indian Penal Code.
It is alleged that the informant was first assaulted by the father of the petitioners, thereafter, petitioner no.1 assaulted on the nose of the informant. The said injury has been found to be grievous, though, other injuries have been found to be simple. It is submitted by learned counsel for the petitioners that for petty dispute, the accusation has been levelled. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the specific accusation against petitioner
Patna High Court Cr.Misc. No.13882 of 2015 (2) dt.03-04-2015 2/2 no.1, this Court is not inclined to grant anticipatory bail to him. Accordingly, the prayer for anticipatory bail of petitioner no.1 is rejected.
So far as petitioner no.2 is concerned, since the accusation is omnibus and general against him, let the above named petitioner no.2 be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Jamui in connection with Khaira P.S. Case No. 222 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
