The petitioner seeks bail in connection with Andhratharhi P.S. Case No.124 of 2016 registered under Sections 413 and 414 of the Indian Penal Code.

The accusation is that on receiving secret information about keeping the stolen motorcycle by this petitioner at his shop, the police reached at the shop of the petitioner and recovered one motorcycle bearing Registration No. BR-09J-3893 from there but on demand of the paper of the aforesaid motorcycle, the petitioner could not reply about the ownership of the same and, on query, the petitioner disclosed that he had purchased the seized motorcycle

Patna High Court Cr.Misc. No.7379 of 2017 (2) dt.10-03-2017 2/2 from one Manohar Kumar Jha but he had not provided any paper of the aforesaid motorcycle saying that the same would be provided to him later on.

Learned counsel appearing on behalf of the petitioner submits that while the police, on investigation, submitted the chargesheet but it has not been detected that the seized motorcycle was of theft property. The petitioner having no criminal antecedent is in custody since 10.10.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Dinesh Kumar, Judicial Magistrate, First Class, Jhanjharpur, Madhubani, in connection with Andhratharhi P.S. Case No.124 of 2016. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
