Patna High Court CR. MISC. No.21726 of 2019(4) dt.25-02-2020 2/2 bail granted to O.P.nos. 2 to 17 , vide order dated 6.11.2018 passed by the C.J.M. Purnea in conenciton with Sadar (Mufassil) P.S.Case no.608 of 2018/CIS 3787 of 2018 under Section 324, 379, 386 and 307 of the IPC.
Ground for cancellation of the bail is that there is specific allegation against the O.P.no.8 of assault by spade but without considering the injury granted anticipatory bail to all the O.P.nos. 2 to 17 .
Heard learned APP and perused the order from which it appears that the learned CJM has granted bail to the O.P.nos. 2 to 17 considering the fact that there is land dispute between the parties and no injury report has been brought on record to show that the injury was grievous or serious in nature and there is no allegation of tampering with the evidence or misuse of the privilege of the bail. In view of the above, there appears no reason for cancellation of bail after more than one year of grant of bail.
Accordingly, this application is dismissed.
