2. The petitioner has prayed for bail in connection with Mohania P.S. Case No.316 of 2024 registered for the offence punishable under Sections 364, 120(B), 302 and 201 of the Indian Penal Code.
3. The case of the prosecution is that the son of the informant, namely, Anil Kumar Goswami was missing from 28.05.2024. The informant believes that Jyoti Kumari, Baleshwar Sah, Sanjay Sah and Nagita Devi have disappeared him. During course of investigation, the dead body was recovered and one Shyam Narain Singh was taken into custody.
Patna High Court CR. MISC. No.13850 of 2025(3) dt.04-04-2025 2/3 Shyam Narain Singh has given his confessional statement and in his confessional statement, he has given every details of the offence. According to his confessional statement, the bike of this petitioner was used for concealing the dead body. The role of this petitioner starts after the murder of the deceased.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. It has further been submitted that there is nothing except the confessional statement of co-accused and that to the effect that this petitioner has helped in concealing the dead body. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. He is languishing in judicial custody since 18.09.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned
