The petitioner has challenged the order dated 04.02.2011 passed by the learned Chief Judicial Magistrate, Bhagalpur in Nathnagar P.S. Case No. 196 of 2009 whereby cognizance has been taken under Sections 467, 468, 471, 420 and 120B of the Indian Penal Code.
It has been urged on behalf of the petitioner that at the time when the alleged manipulation had taken place, the petitioner was only four years old. In the absence of the counsel for the petitioner, this Court is not in a position to know about the stage of
Patna High Court CR. MISC. No.11504 of 2015(2) dt.07-05-2019 2/2 the case. However, if the case still continues against the petitioner and the trial has not begun, it would be open for the petitioner to prefer a petition for discharge, if not already made, which shall be decided by the competent/concerned court in accordance with law. With the aforesaid direction/observation, the petition is disposed of.
