JUSTICE RAJESH KUMAR VERMA ORAL ORDER 29-04-2026 Heard Mr. Anuj Kumar, learned counsel for the petitioner, Mr. Ranjit Kumar Thakur, learned counsel for the informant and Mr. Akshay Lal Pandit, learned Additional Public Prosecutor for the State.
2. Petitioner seeks bail who is in custody since 17.09.2025 in connection with Bidupur P.S. Case No. 557 of 2025, F.I.R. dated 27.08.2025 for the offences punishable under Sections 103(1), 6k1(2) and 3(5) of the BNS, 2023 and Sections 25(1-b)a, 26, 35 and 27 of the Arms Act.
3. According to prosecution case, some unknown persons have shot fire upon the husband of the informant resulting into his death.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.11674 of 2026(3) dt.29-04-2026 2/3 petitioner is innocent and he has falsely been implicated in the present case. He further submits that the petitioner is not named in the FIR and his name has been transpired during investigation on the basis of the self confessional statement of the petitioner which was recorded in Industrial P.S. Case No. 140 of 2025 and except the aforesaid, no other material has come during investigation which suggest the involvement of the petitioner in the present occurrence. Apart from that the present FIR has been instituted on 27.08.2025 and before that the inquest report has been prepared on 25.08.2025 and the postmortem was conducted on 26.08.2025.

Learned counsel for the informant as well as learned Additional Public Prosecutor have vehemently opposed the prayer for bail of the petitioner and submits that the petitioner has confessed his guilt in the present occurrence which was recorded in paragraph no. 33 of the case diary. Thereafter, on the basis confessional statement of the petitioner the arms which was used in present crime in question was also recovered from the house of the petitioner and the same has been recorded in paragraph no. 35 of the case diary. Apart from that the petitioner carries two criminal antecedents other than the present one.
6. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.11674 of 2026(3) dt.29-04-2026 3/3 of the case, I am not inclined to enlarge the petitioner on bail in connection with Bidupur P.S. Case No. 557 of 2025 pending in the court of learned CJM, Vaishali at Hajipur.
