This application has been filed in connection with Special (POCSO) Case No.3 of 2017 arising out of Khagaol P.S.Case No.02 of 2017 for the offence under Sections 341, 323, 504, 506, 354 and 34 of the Indian Penal Code.
Allegation against the petitioner has been made for the offences under Section 354 and other Sections of the Indian Penal Code and there is direct allegation against this petitioner, however, it has been submitted on behalf of the petitioner that he has been falsely implicated in this case on the basis of village politics. He has remained in custody for more than three months. Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.17216 of 2017 (2) dt.13-04-2017 2/2 Having heard both sides and in view of allegation, I am not inclined to grant bail to the petitioner at this stage, however, the petitioner may renew his prayer for bail after framing of charge in this case.
With the aforesaid observation, this application is dismissed.
