This is one of the matters in which though plot was allotted to the petitioner in Digha but possession could not be given by the Housing Board due to encroachment. However, in view of the enforcement of Digha Acquired Land Settlement Act, 2010 in particular Sections 4 and 5, all the previous allotments stood annulled and the petitioner would only be entitled for refund of the amount which has been deposited by him along with compound interest @ eight per cent per annum.
Accordingly, this writ petition stands disposed of with a direction to the Managing Director, Bihar State Housing
Patna High Court CWJC No.2108 of 2016 dt.29-11-2016 Board, Patna to calculate the amount to be paid to the petitioner along with compound interest at the aforesaid rate from the date of deposit of such amount by him within a period of three months from the date of receipt/production of a copy of this order.
