The petitioner seeks bail in connection with Gardanibagh P.S. Case No. 05/2017, registered for the offences punishable under Sections 417, 420 and 34 of the Indian Penal Code. Allegedly, the petitioner impersonated for other candidate in the examination.
Submission is of false implication and that in this case similarly situated co-accused Manohar Kumar, Mintu Kumar and Raju Kumar have already been allowed bail by another coordinate Benches of this Court and as such, the petitioner also deserves sympathetic consideration as he is in custody since 11.01.2017 having no criminal antecedent.
Patna High Court Cr.Misc. No.9520 of 2017 (2) dt.12-04-2017 2/2 Learned A.P.P. fairly submits that other co-accused has already been allowed bail.
In the facts and circumstances stated above, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge XIV-cum-Additional Chief Judicial Magistrate, Patna in connection with Gardanibagh P.S. Case No. 05/2017, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
