JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-05-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 302, 304 (B) and 120 (B) of the Indian Penal Code.

Petitioners are parent-in-law of the deceased. No doubt, deceased died in other than normal circumstances within 16 months of her marriage at her matrimonial home and there is allegation of torturing as well as demand of dowry against her husband and in-laws but the postmortem report goes to show that the cause of death of deceased was asphyxia. Moreover, it is informed on behalf of the petitioners

Patna High Court CR. MISC. No.11317 of 2019(4) dt.21-05-2019 2/2 that the husband of the deceased has surrendered before the Court below today.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in view that petitioners are in custody since 28.09.2018, let the petitioners, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Dighalbank P.S. Case No. 85 of 2018.
