The petitioner is apprehending arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
It is alleged by the informant while he was going to attend marriage ceremony, in the way, miscreants looted his mobile, the miscreants also looted cash and others articles of several vehicles. The FIR was registered against unknown when the name of the petitioner sprang up during investigation. It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Patna High Court Cr.Misc. No.14175 of 2015 (3) dt.05-05-2015 2/2 The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Chandramandih P.S. Case No.39 of 2011, pending before the learned Chief Judicial Magistrate, Jamui keeping in view of the fact that other similarly situated persons have been granted anticipatory bail vide ABP Nos. 836 of 2012 and 1040 of 2012.
With the above observation, this application is, accordingly, disposed off.
