2. The petitioner is apprehending his arrest in connection with Manjhaul P.S. Case No. 91 of 2024 for the offence under sections 126(2), 115(2), 109(1), 74, 303(2), 352/3(5) of the B.N.S. lodged on 04.11.2024 by the informant, Nitu Devi.
3. As per the prosecution story, the informant alleged that on a pity issue, a fight took place in which Niranjan Ishwar assaulted her. The allegation of assault is on this petitioner also which led the FIR.
4. Learned counsel for the petitioner submits that both are sister-in-law (gotni), scuffle took place which has been exaggerated, Niranjan Ishwar went to the judicial custody and is
Patna High Court CR. MISC. No.10729 of 2025(3) dt.12-05-2025 2/3 now out of jail. The last submission is that without accepting the allegation and/or the outcome of the present case, the petitioner intends to contribute Rs. 5,000/- to the informant, Nitu Devi.
5. Learned APP opposes the prayer submitting that allegation is on this petitioner also.
6. Taking into account the submissions of the parties as also the fact that the main role has been attributed to Niranjan Ishwar, this petitioner is a lady having no criminal antecedent, undertaking has been given that she shall be diligently appear in trial, in that background, this Court is inclined to extend him the privilege of anticipatory bail with conditions, subject to the payment of Rs.5,000/- to the informant, Nitu Devi, by way of Demand Draft issued by the local State Bank of India through the Trial Court after checking credentials.
7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M., Manjhaul, Begusarai, in connection with Manjhaul P.S. Case No.91 of 2024 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (i) one of the bailor should be the family

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) anand/- U T
