The present Cr. Writ Petition has been filed against the order dated 06.02.2021 passed in Cr. Revision No. 303 of 2020 by Sessions Judge, Samastipur.

Learned counsel for the petitioner submits that is a matter arising out of proceeding under Section 144 of Cr.P.C. Learned counsel for the private respondent submits that the first case was filed by the petitioner and the matter was decided in favour of petitioner, being aggrieved and dissatisfied

Patna High Court CR. WJC No.486 of 2021(2) dt.17-04-2023 2/2 with the order passed by S.D.M. Dalsingsarai the respondent No.6 have preferred Cr. Revision No. 303 of 2020 which was decided on 06.02.2021 finally in favour of respondent No.6. Technically I found true that the order dated 06.02.2021 passed in Cr. Revision No. 303 of 2020 by Sessions Judge, Samastipur is revisable in nature because right of revision is vested in party but instead of preferring revision the present criminal writ petition has been filed. In this view of the matter, without entering into the merit of the case, the present Cr. Writ Petition stands disposed off with liberty that petitioner may raise his grievances before appropriate forum.
