Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 307, 427, 353, 435, 283, 120(B), 121(A) and 129(A) of the Indian Penal Code, Section 27 of the Arms Act, Section 3 of Damage Public Property Act, Section 17 of C.L.A. Act and Sections 10 and 13 of U.A.P. Act.
Petitioner is in custody since 28.12.2017.
Allegation is that the FIR named accused belongs to Maoist group.
Submission is that in the past prayer for bail was refused, however, the trial has taken no progress. Considering the facts of this case aforesaid especially
Patna High Court CR. MISC. No.20865 of 2021(2) dt.23-08-2021 2/2 period already undergone by the petitioner and no chance of conclusion of the trial in near future, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr. No.78 of 2019 (46 of 2019) arising out of Amas Police Station Case No.88 of 2015 with following conditions:
(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
