Petitioners seek regular bail in connection with Andar PS Case No. 01/2022 registered for the offence punishable under Sections 25 (1-b) a, 26, 35 of the Arms Act & Section 30(a) of Bihar Prohibition & Excise Act.

A Bolero Vehicle bearing BRO1PA-1442 was intercepted and 673.92 litres of illicit liquor was recovered along with one loaded pistol from the said vehicle. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he is having no criminal antecedent. Patna High Court CR. MISC. No.11406 of 2022(2) dt.25-05-2022 2/2 was not aware about the liquor and illegal arms kept therein. Petitioner is in custody since 05.01.2022 and the charge-sheet has been submitted in the matter.

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is neither the driver of the vehicle nor the owner of the same, no illicit liquor has been recovered from his conscious possession, petitioner is in custody since 05.01.2022 and the charge-sheet has been submitted in the matter, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cumSpecial Excise, Siwan in connection with Andar PS Case No. 01/2022.
