JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-05-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 23.09.2015 on the accusation that he was caught with counterfeit notes and illegal firearms and taking note of the aforesaid facts, earlier, the prayer for bail of the petitioner was rejected by this Court vide order dated 13.01.2016 passed in Cr. Misc. No. 146 of 2016. Submission on behalf of the petitioner is that petitioner is in jail custody since long but uptil now, the case of the petitioner could not be committed to the court of sessions. It is further submitted that as a matter of fact, prior to institution of the present case, the petitioner was falsely implicated in Nautan P.S.

Patna High Court Cr.Misc. No.10586 of 2017 (3) dt.03-05-2017 2/2 Case No. 47 of 2015 registered under sections 420, 489A, 489B and 489C of the Indian Penal Code and as a matter of fact, one Nagendra was caught with motorcycle and counterfeit notes but to save his skin, police again implicated the petitioner in this false case.

Considering the period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate,-Vith Bettiah, West Champaran in connection with Trial no. 1386 of 2016 arising out of Nautan P.S.Case No. 321 of 2015.
