The petitioner is accused in connection with Aurai P.S. Case No. 82 of 2015, registered under Section 302/34 of the Indian Penal Code.
The informant Renu Devi after receiving the information about death of her husband Narendra Rai lodged Auri P.S. Case No. 82 of 2015, under Section 302/34 I.P.C. against unknown.
Learned counsel for the petitioner submits that the petitioner is the Pattidar of the deceased and in the morning of date of occurrence, hot talks were exchanged between deceased and the petitioner regarding ploughing of filed. Thereafter, in the night deceased died due to chest pain, but with ulterior motive,
Patna High Court Cr.Misc. No.14234 of 2017 (2) dt.08-04-2017 2/2 petitioner has falsely been implicated in this case. Further submission is that witnesses in paragraphs 6, 7 and 8 have only stated about quarrel in between the deceased and the petitioner. Whereas, aunt of the deceased in para-09 has stated that deceased was suffering from chest pain and when she returned with medicine at the house, she found Narendra Rai dead. Further submission is that petitioner has no criminal antecedent and she is in custody since 24.11.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in connection with Aurai P.S.
