The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and other sections of the Indian Penal Code.

As per the prosecution case, it is stated that over a fight between the son of the informant and Uday Kumar in course of playing, it is stated that Uday Kumar went back home and called the members of his family. On the orders of the petitioner, all the accused persons assaulted the informant and the members of his family leading to the death of his mother. It is submitted by learned counsel for the petitioner that the allegations as levelled in the F.I.R. are false and

Patna High Court CR. MISC. No.20626 of 2021(2) dt.23-09-2021 2/2 concocted. The petitioner has been falsely implicated in the case. There is case and counter case between the parties. The allegations are not supported from the contents of the postmortem report (Annexure-3) wherein only one injury has been found on the body of the deceased. The correct version has been mentioned in the counter case, F.I.R. of which has also been brought on record. The petitioner who is only alleged to be the order giver, is in custody since 15.8.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the general and omnibus allegation against the petitioner together with the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Dehri Town (Indrapuri) P.S. Case no.578 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Dehri-on-Sone, District Rohtas.
