Petitioner, already in custody, seeks bail in connection with Barachatti P.S. Case No.340 of 2016, registered under Sections 272, 273 and 120(B) of the Indian Penal Code as well as Sections 47(a), 48(2), 54 and 63 of the Bihar Excise (Amendment) Act, 2016.
Allegation in brief is that the police during vehicle checking, checked one bus coming from Jharkhand and from its dickey recovered six plastic sacks each containing 25 bottles of foreign liquor in total 101 litres. The driver and cleaner of the bus disclosed that this petitioner along with others had loaded the said sacks in the bus.
Learned counsel appearing on behalf of the
Patna High Court Cr.Misc. No.11435 of 2017 (3) dt.17-03-2017 2 / 2 petitioner submits that nothing was recovered from the conscious possession of the petitioner. It was recovered from the dickey of the bus and except disclosure by driver and cleaner that this petitioner was carrying liquor, there is no other material against the petitioner and this petitioner has been in custody since 03.09.2016, having no criminal antecedent.
Having considered the said facts and circumstances, petitioner Ranju Devi @ Ranjan Devi is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sherghati at Gaya in connection with Barachatti P.S. Case No.340 of 2016.
