Petitioner seeks bail in a case registered for the offences punishable under Sections 376, 493 and 506/34 of the Indian Penal Code.
Petitioner has filed an affidavit that he is ready to marry with the victim-girl who is already mother of a child from the petitioner. The victim is also ready to marry with the petitioner as the matter was of love affairs between the two. In the circumstance, let the petitioner, above named, be released on provisional bail for three months from the date of release on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bihta Police Station Case No. 427
Patna High Court CR. MISC. No.20937 of 2021(3) dt.28-10-2021 2/2 of 2020, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.
(c) The petitioner shall not leave the country without permission of the learned trial court.
In the meantime, the petitioner would marry with the victim and shall file affidavit before the learned court below in support of the marriage thereafter the learned court below shall confirm the provisional bail of the petitioner. (Birendra Kumar, J) Kundan/- U T
