No. 7, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 147,148,149,302,120B and 380 of the Indian Penal Code and section 27 of the Arms Act.

It is alleged that the accused persons including the petitioner entered into the house of the informant, Bhola Rai and Pappu Rai dragged the informant out of the house, thereafter the petitioner assaulted with country made pistol on the head of the informant. It is further alleged that co accused Akhilesh Rai and Baleshwar Rai fired at the husband of the informant who succumbed to the injuries. The accused persons took away articles

Patna High Court Cr.Misc. No.14227 of 2013 (3) dt.13-03-2015 2/2 and ornaments from the house of the informant. It is submitted by learned counsel for the petitioner that since the petitioner was on inimical terms with the informant side from before, hence, he has been roped in the present case. It is submitted by learned counsel for the informant that the petitioner was in league with other accused persons who killed the husband of the informant and the injury report of the informant corroborates the accusation levelled against this petitioner.

Considering the nature of accusation, this court is not inclined to grant anticipatory bail to the petitioner in connection with Hathauri P.S. Case No. 14 of 2012 pending in the court of learned C.J.M., Muzaffarpur. .

This application is accordingly dismissed.

The interim order of stay stands vacated.

Let the trial be expedited.
