2. The petitioner seeks regular bail in connection with Alamganj P.S. Case No.1083 of 2025 for the offences registered under Sections 317(5) & 3(5) of the B.N.S., 2023.

3. As per the prosecution case, when the police team were on vehicle checking near Bhadra Ghat, in the meantime a brown color scooty was coming from Gaighat and on suspicion, they asked to stop but the driver of scooty started fleeing. On chase co-accused Sukku @ Gopal Yadav was apprehended who disclosed that the said vehicle is stolen by him and his friend coaccused Sohail Hussain.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He further submits that petitioner was not present at the spot and no incriminating article has been recovered from his conscious possession. Learned counsel submits that petitioner is not named

Patna High Court CR. MISC. No.11713 of 2026(2) dt.26-02-2026 2/2 in the F.I.R., rather his name is transpired in this case during the investigation on the confessional statement of the co-accused Md. Sohail Hussain. He further submits that except the confessional statement of the co-accused, there is no material against the petitioner to link him with the alleged offence. Learned counsel submits that petitioner is a young boy of 22 years having got clean antecedent, he is in custody since 13.10.2025 and he undertakes to co-operate in the investigation and trial.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions made on behalf of the parties, facts and circumstances of the case, the nature of allegation against the petitioner and the fact that petitioner is a young boy of 22 years having clean antecedent as well as the period of custody already undergone by him, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Patna City, Patna/ concerned Court in connection with Alamganj P.S. Case No.1083 of 2025.
