JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420, 406, 467, 468, 120B of the Indian Penal Code.

It is alleged that the informant supplied construction materials worth Rs.65,000/- along with Rs.35,000/- cash to the petitioner, being the headmaster of the school. The petitioner issued a cheque of Rs.1,00,000/- to the informant which got bounced on the ground that signatory of said account has already been changed.

It is submitted by learned counsel for the petitioner that the informant has received the entire amount of Rs.1,00,000/-. Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for a period

Patna High Court Cr.Misc. No.13063 of 2015 (2) dt.30-03-2015 2/2 of three months, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Raxaul, East Champara in connection with Adapur (Harpur) P.S. Case No.98 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The petitioner and informant will appear before the learned Court below within a period of three months and if the informant admits that he has filed a compromise petition before the learned court below then the provision bail of the petitioner will be confirmed by the learned court below otherwise the petitioner will surrender and pray for regular bail.
