The petitioner seeks bail in Palasi P.S. Case No. 211 of 2021, registered for the offence punishable under Sections 363/34 of the Indian Penal Code. Later on, sections 302, 364(A)/201 IPC were added.

As per the FIR, on 17.10.2021 at 9.00 AM son of the informant had gone to purchase some articles to Kishan Chowk, but he did not return. During course of search, informant came to know that petitioner along with co-accused Inod Mandal and some other criminals in connivance have kidnapped the minor son of informant. During course of investigation after recovery of dead body of informant's son sections 364A, 302, 201 IPC has been added.

It is submitted on behalf of the petitioner that from

Patna High Court CR. MISC. No.11331 of 2022(2) dt.05-05-2022 2/2 bare perusal of FIR it is apparent that only suspicion has been raised against this petitioner. Informant is not eye-witness of the occurrence. In the FIR, the source of information has also not been disclosed. Petitioner claims clean antecedent and he is in custody since 19.10.2021.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Palasi P.S. Case No. 211 of 2021.
