JUSTICE BIRENDRA KUMAR ORAL ORDER 24-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 25(1-B)a, 26/35 of the Arms Act. From the house of this petitioner four rifles and cartridges were allegedly recovered. The petitioner was not present at the time of recovery. However, in paragraph 3 of the bail petition it is stated that petitioner is accused in some other cases also. Petitioner is in custody since 15.07.2016. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail in connection with Khanpur P.S. Case No.28 of 2005 pending in the court of learned A.C.J.M.-III, Samastipur is

The learned court below is directed to expedite the trial and conclude the same preferably within nine months from the date of receipt of this order. Thereafter, the petitioner would be at liberty to renew his prayer for bail before the learned court below itself.
