Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 20, 22, 23, 24, 27(A) and 29 of the N.D.P.S. Act. From the house of Shankar Sah, Mohan Sah and Ramayan Sah 10 Kgs, 4 Kgs and 3 Kgs Ganja were recovered. Co-accused Ramayan Sah confessed that Ganja were being supplied by this petitioner.
It is submitted by learned counsel for the petitioner that admittedly there is no recovery from the petitioner and except confession of the co-accused before the police, there is no material against the petitioner. It is further submitted that though petitioner is accused in two other cases
Patna High Court Cr.Misc. No.9172 of 2015 (2) dt.04-03-2015 2/2 but these two cases are not registered under the N.D.P.S. Act. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, West Champaran at Bettiah in connection with Shikarpur P.S. Case No. 112 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
