====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2019 Heard learned counsels for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 17.09.2018 in a case for the offence registered under Sections 419, 420, 467, 468 and 120(B) of the IPC.

The prosecution story, in brief, is that on 14.09.2018 the informant being the Branch Manager, Canara Bank, BranchHarrakh, Begusarai, was discharging Bank works, where coaccused Raja Babu came to close his Bank A/C No. 5750101002739 but on asking, he has not replied satisfactory and also stated about missing of his Pass Book then informant on suspicion, verified his Bank Account No. 5750101002739 and found deposit of Rs. 7,13, 053/- through Mobile Net Banking in between 21.06.2018 to 14.09.2018 and also revealed

No.14303 of 2019(3) dt.22-07-2019 2/3 withdrawal of Rs. 7,12,388.40 through ATM and then informant made further inquiry with Raja Babu, he disclosed name of this petitioner, co-accused Indal Kumar and Pince Kumar who took his Pass Book, ATM Debit Card and Pin Number on the pretext of verification from Patna. He also suspected about transaction in his bank account by them.

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is no substantive evidence to suggest the implication of the petitioner in the present case. There is no wrongful gain made on the part of the petitioner nor any wrongful loss has been caused to the informant by the petitioner. On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Begusarai, in connection with Begusarai Town P.S. Case No.
