The petitioner has filed the instant application for grant of regular bail in connection with Lakhisarai (Amhara) P.S. Case No. 436 of 2020 registered under sections 147, 149, 307 and 498A of the Indian Penal Code and 3/4 of the Dowry Prohibition Act and later on Section 306 of IPC was added. Allegation against the co-accused persons including this petitioner is that when the informant was cooking food, in the meantime, the co-accused persons including this petitioner came and poured kerosene oil on her body and set her on fire due to which she suffered severe burn injury. Patna High Court CR. MISC. No.11870 of 2023(2) dt.24-04-2023 2/3 dowry demand of jewellery being demanded by them after her marriage. The informant died during the course of treatment. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is sister-in-law of the deceased due to which she has falsely been implicated in this case. It is further submitted that she has no concern with mess and business of the deceased as well as from her husband and also she lives separately from them. The husband of the deceased is already in judicial custody. It is also submitted that the the husband of this petitioner who is also named in F.I.R., has already been granted bail by the different co-ordinate Bench of this Court vide order dated 03.02.2022 in Cr. Misc. No. 50718 of 2021. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, she is languishing in judicial custody since 20.11.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as the petitioner being a lady, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is

Case No. 436 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai.
