JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-03-2016 Heard learned counsel for the petitioner and Mr. Vinay Kirti Singh, learned counsel for the South Bihar Power Distribution Company Limited.
Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 406, 409 of the Indian Penal Code.
The prosecution case is that the petitioner having franchisee of collecting the revenue on behalf of West Champaran Power Distribution Company and collected revenue till 15th July, 2015 to the tune of Rs. 12,06,682, but part of the money was not deposited with the authorities. The net claim remains to be Rs. 2,68,646/-. The petitioner is ready to deposit the amount within three months, if the demand is issued after settling the account.
Patna High Court Cr.Misc. No.9295 of 2016 (2) dt.01-03-2016 It is submitted by the learned counsel for the South Bihar Power Distribution Company that authorities are ready to issue fresh demand after settling the account within a period of four weeks.
Considering the present stand of the petitioner, let the above named petitioner be released on provisional anticipatory bail for three months in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Lauriya P.S. Case No. 213 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. The provisional bail of the petitioner will be confirmed by the learned court below on deposit of the due settled amount within three months from today and six weeks from the date of receipt of the demand notice.
