JUSTICE SANJAY KUMAR ORAL ORDER 15-02-2017 Heard learned counsel for the petitioners and learned APP appearing on behalf of the State.

The petitioners seek regular bail in connection with Rajauli P.S. Case No. 318 of 2016 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition & Excise Act, 2016.

Both the petitioners are alleged to be caught by the police after some chase when they started fleeing away leaving the vehicle. The police seized 31.5 liters wine containing in 66 bottles from the vehicle in question.

Learned counsel for the petitioners submits that the petitioners have denied the allegation of recovery from their

No.5609 of 2017 (2) dt.15-02-2017 2/2 possession and claims false implication by the police as they refused to put their signatures on some paper in connection with the recovery from other vehicle i.e. pick van. The petitioner is in custody since 14.12.2016, having no criminal antecedent. Learned APP for the State opposed the submission. Considering the nature of allegation and the facts and circumstances stated above, the prayer of bail is allowed. The petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Rajauli P.S. Case No. 318 of 2016.
