Irshad, AC to SC-1, appears for the State and Mr. Sanjay Pandey, learned counsel, appears for the Bihar Public Service Commission. The petitioner prays for a direction in the nature of mandamus commanding the respondents to publish her fresh marks sheet after adding the interview marks in terms of Advertisement No. 15/2014 for filling up the post of Medical Officer.

A counter affidavit filed on behalf of the Commission is on record and Mr. Pandey in reference to the statement made in paragraph 12 of the counter affidavit has submitted that while total marks secured by the petitioner together with the marks obtained in interview is 43.56, the last of the candidate appointed under

Patna High Court CWJC No.2412 of 2016 (2) dt.20-12-2017 general category carried 53.04 marks, which was the cut off for general category and thus, the petitioner did not make it to the appointment.

In view of the statement made in paragraph 12 of the counter affidavit, which is not contested, the writ petition is disposed of.
