JUSTICE SANJAY PRIYA ORAL ORDER 18-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Phulwarisharif (Janipur) P.S. Case No. 703 of 2016 instituted for the offence under Section-379 of the Indian Penal Code.
It has been submitted that the petitioner has no criminal antecedent. He is a handicapped person. In the written report, it is alleged that motorcycle of the informant got stolen.
The C.D. has been received.
Learned APP has submitted that in the case diary, it has come that alleged motorcycle has been recovered from possession of three persons including this petitioner. They disclosed the name of this petitioner in their confessional
Patna High Court Cr.Misc. No.12780 of 2017 (3) dt.18-04-2017 2/2 statement. The petitioner is said to be in custody since 22-112016. In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Phulwarisharif (Janipur) P.S. Case No. 703 of 2016 to the satisfaction of Smt. Sema Eram, learned Judicial Magistrate-Ist Class, Patna subject to condition that both the bailors should be close relatives of the petitioner.
